Current Bill Summary

SCS/SB 477 - This act requires the disclosure of persons infected with Human Immuno-Deficiency Virus (HIV) in certain situations. Current law states that information regarding an individual's HIV status is confidential, but may be disclosed to certain individuals listed in the section. This act adds peace officers and prosecuting attorneys possessing a compelling need for disclosure of HIV-status for the investigation of and adjudication of a criminal proceeding.

The act also requires the Department of Corrections to notify the parents of any unemancipated minor victim of a sexual offense of any confirmed positive results of HIV testing of the offender in the Department's custody (SB 158).

This act is similar to SS#2/SCS/HB 191 and HB 271.
