Current Bill Summary

SCS/SB 396 - This act designates the State Fire Marshal or his staff as peace officers, if they are certified as such. Current language requires 240 hours of police training, and limits this designation to circumstances where the fire marshal or staff is being assaulted.

The power of the fire marshal and staff to arrest is expanded to all offenses incidental to their investigation. The power to arrest requires prior notification to the county sheriff or chief of police of the marshal's investigation. Current language limits the arrest power to fire related offenses and only when investigating such offenses.

This act is similar to HB 792.
