HCS/SCS/SB 334 - "BROWN FIELD" CLEANUP - This act applies the voluntary remediation or "brown field" statutes to residential real property. The "brown field" cleanup provisions, Sections 260.565 to 260.575, RSMO, currently apply only to non- residential real property. The act also includes petroleum and petroleum products in the definition of "hazardous substance", except where such petroleum and petroleum products were released to the environment from tanks subject to regulation by the Department of Natural Resources or on property eligible for reimbursement from the Petroleum Storage Tank Insurance Fund.

GROUNDWATER CONTAMINATION - The act requires the Clean Water Commission to establish procedures to determine if remediation of groundwater is appropriate on a site-specific basis. The Commission procedures shall consider: the impacts on public or private drinking water supplies; the likelihood that contaminated groundwater will be used as a drinking water supply; the impact on any natural springs; the appropriateness of natural attenuation of the contamination and any other scientific factors the Commission deems relevant.
