SCS/SB 239 - This act describes the powers of the board of hospital trustees (the board). Section 205.190 delineates qualification and organization requirements of the board. It prohibits any trustee from receiving compensation, but allows for the reimbursement of expenses. The board may make rules and regulations and will control the hospital fund, with exceptions. In addition, the board will be responsible for purchase, construction, or lease of hospital grounds, rooms, or buildings.

Except in counties of the third or fourth classification where an organized hospital already exists, the trustees will have authority to operate, maintain, and manage the hospital and facilities. However, any lease of substantially all of the hospital may be entered into only upon approval of the county commission of any first classification, non-charter county, which has the authority to separately negotiate and enter into contractual agreements with the lessee as a condition of approval of the lease.
