Current Bill Summary

SS/SB 141 - This act expands the medical malpractice statute of limitations. The added section allows a claimant to bring an action for failure to inform the patient of results of medical tests within two years of either the discovery of such failure or the date when the claimant should have discovered the negligence, whichever occurs first.

The general exception for claims by minors is also changed. Current law gives minors under the age of ten until age twelve to sue, in addition to any other exceptions that may apply. This act changes the exception to now give minors under age eighteen until age twenty to sue, in addition to other exceptions.

This bill is similar to HS/HCS/HB 274.
