FISCAL ANALYSIS

ASSUMPTION

Officials of the following agencies stated they would not be directly affected fiscally by this proposal: Governor, Lieutenant Governor, Attorney General, State Treasurer, Tax Commission, Auditor, Department of Higher Education, Courts Administrator, Missouri Conservation Department, Department of Elementary and Secondary Education, Department of Mental Health, Department of Transportation, Department of Agriculture, Consolidated Health Care Plan and Highway Patrol.

Officials of the following agencies indicated that they were uncertain about the fiscal effects of the proposal: Office of Administration, Department of Revenue, Department of Labor and Industrial Relations, Department of Insurance, Department of Social Services and Department of Natural Resources.

Oversight assumes that the proposal is designed to make explicit the constitutionality of the legislature's authority to review, modify and rescind rules and regulations promulgated by executive branch agencies. Any fiscal impact on state agencies would depend upon changes to chapter 536 made after approval of this proposal by the voters of Missouri.

Advertisement costs for the proposal would be $3,990 per newspaper column inch for three publications of the text of the proposal, the introduction, title, fiscal note summary, and affidavit. The proposal would be on the ballot for the November 1998 general election.

DESCRIPTION

This proposal would make all non-internal organization and management rules and regulations of executive branch agencies promulgated under provisions of chapter 536 subject to legislature review before the effective dates of the rules.

This legislation is not federally mandated, would not duplicate any other program, would not require additional capital improvements or rental space, and would not affect total state revenue.
