FISCAL ANALYSIS

ASSUMPTION

Officials of the Department of Public Safety, Division of Liquor Control, the State Public Defender, the Office of State Courts Administrator, the Attorney General's Office, and the Office of Prosecution Services assume this proposal would not fiscally impact their agencies.

The Gaming Commission (GAM) did not respond to our fiscal impact request. Oversight assumes this proposal would not fiscally impact GAM.

FISCAL IMPACT - Small Business

This proposal would affect small businesses who choose to use such gambling devices, as these businesses may realize revenues from them.



DESCRIPTION

This proposal removes from the definitions of "gambling" and "gambling device" any amusement device that gives the customer either a right of replay or a coupon, prize, game, or credit that can be redeemed for something of value, excluding cash, intoxicating liquor, nonintoxicating beer, or tobacco products.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
