FISCAL ANALYSIS

ASSUMPTION

Officials of the Office of State Courts Administrator and the Office of Prosecution Services assume this proposal would not fiscally impact their agencies.

The office of the Boone County Prosecuting Attorney and the Monroe County Prosecuting Attorney assume this proposal would not fiscally impact them.

Oversight assumes this proposal would consolidate the salary schedule for all part-time prosecutors, regardless of the county classification. To accomplish this, the salaries of part-time prosecutors in second-class counties are changed to those of prosecutors in third or fourth-class counties. Because there are currently no part-time prosecutors in second-class counties, Oversight assumes this proposal would have no fiscal impact.

Officials from the following offices did not respond to our fiscal impact request: Cass County Prosecuting Attorney, Greene County Prosecuting Attorney, Butler County Prosecuting Attorney, Bates County Prosecuting Attorney, St. Louis County Prosecuting Attorney, Cole County Prosecuting Attorney, Franklin County Prosecuting Attorney, and the Clay County Prosecuting Attorney.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION

This proposal revises several provisions regarding salaries of prosecuting attorneys. In any county in which all salaries have been set at 100% of the maximum allowable compensation, the commission may vote to increase the compensation of all offices except that of full-time prosecuting attorneys. In counties with correctional centers, the prosecuting attorney receives additional compensation according to the number of inmate population. These additional amounts shall be included in the computation of the maximum allowable compensation.

This proposal also allows full-time prosecuting attorneys of first classification counties to accept appointments as special prosecutors, and consolidates the salary schedule so that there is only one salary for all part-time prosecutors regardless of county classification. This proposal becomes effective on December 31, 1998.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
