ASSUMPTION

The following agencies/offices/commissions would not be impacted fiscally by this bill: Administration, Agriculture, Conservation, Elementary and Secondary Education, Higher Education, Highways and Transportation, Natural Resources, Public Safety, Revenue, Governor, Lt. Governor, Social Services, Secretary of State, Courts Administrator, Tax, Health, Economic Development, Gaming, Chief Clerk of the House, Secretary of the Senate, Auditor, Treasurer, Labor and Industrial Relations, Veterans, Capitol Police, Harris-Stowe State College, Southwest Missouri State University, University of Missouri, Missouri Western State College, Truman State University.

Officials from the Department of Insurance assume the proposal would lead to no additional costs, unless a judgement would be in excess of the limits provided - in which case the additional costs would be undeterminable.

Officials from the Department of Corrections, Department of Mental Health, Office of the Attorney General, Missouri Lottery Commission, Lincoln University, Missouri Southern State College, Northwest Missouri State University, Central Missouri State University, and Southeast Missouri Sate University did not respond to our fiscal note request.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.

DESCRIPTION

This proposal specifies that the Missouri Public Entity Risk Management Fund may be used to pay tort claims against an officer or employee of a participating entity only in accordance with the coverage obtained by the entity. The proposed legislation also clarifies that the Fund's board of trustees will defend a claim in accordance with the entity's coverage.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
