FISCAL ANALYSIS

ASSUMPTION

Officials from the Office of Administration and Office of State Court's Administrator assume this proposal will not fiscally impact their agencies.

Officials from the St. Louis County Family Court indicated the proposal would increase their revenues by $1,515,300 each year from FY 99 to FY 01. This is due to the increase in reimbursable costs from $14 to $37.50 per day for each child cared for by the county.

Officials from the Department of Social Services (DOS) assume this proposal will impact state funds as the proposal increases the per diem the state pays counties for children in detention from $14 to $37.50 per day.

The DOS projected in its FY 99 budget request that it will reimburse counties for 257,231 days of detention in FY 99. Multiplying the numbers of days of detention by the increase in costs per day ($23.50) totals $6,044,929 for FY 99. Costs for FY 00 and FY 01 were increased by 2.5 % annually resulting in costs of $6,196,052 and $6,350,953, respectively. As the proposal has an emergency clause for the legislation to take effect July 1, 1998, the costs for FY 99 were not prorated. All costs were assumed to be appropriated from the General Revenue Fund based on prior funding sources.

No direct fiscal impact to small businesses would be expected as a result of this proposal.

DESCRIPTION

The state payments to counties which own or operate homes for neglected and delinquent children are now fourteen dollars per day per child. This proposal would raise that amount to thirty-seven dollars and fifty cents per day. In addition, when a child is detained in a facility as provided in Section 211.151, RSMo, the state payment would also be increased from fourteen dollars per day to thirty-seven dollars and fifty cents per day per child. The proposal has an emergency clause to take effect on July 1, 1998.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
