FISCAL ANALYSIS

ASSUMPTION

The Department of Natural Resources (DNR) assumes the proposed legislation states the commission shall formulate policies and general programs for the saving of Missouri soil and water by the soil and water conservation districts; it shall formulate the necessary policies and programs for protecting the productivity power of Missouri's agricultural land as identified by the soil and water conservation districts.

The DNR assume the Soil and Water sales tax funds provide the funding for the soil and water conservation activities and the uses of these funds are authorized in the constitution. The policies and programs submitted to the commission would need to meet the constitutional use of the soil and water sales tax funds. The policies and programs that fall outside of the use would need to be funded from an alternate funding source. The DNR is unable to determine the number of policies and programs that would need an alternate funding source. Therefore, the fiscal impacts are unknown.

Oversight assumes the DNR will determine what, if any, policies and programs will be necessary to protect the productivity power of Missouri's agricultural land. Oversight also assumes the appropriate funding sources will be identified in the regular budgeting process.

DESCRIPTION

This act expands the mission of the Soil and Water District Commission (SWDC) by mandating the SWDC formulate policies and programs for protecting the productivity power of Missouri's agricultural land as identified by the soil and water conservation districts within the land resources areas that are determined by the federal Natural Resources Conservation Service.

This act corrects a conflict between two printed versions of Section 278.080 relating to the SWDC. The act requires the Commission's composition to include six farmer members, three of whom must reside north of the Missouri River and three to the south. No senatorial district may contain more than one member.

The number of voting farmer members required to determine an action is reduced from four to three where a quorum of four farmer members is present. The Chairman is now allowed to vote on any matter.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
