FISCAL ANALYSIS

ASSUMPTION

Officials of the Office of State Courts Administrator, Department of Revenue, Attorney General's Office, Office of Prosecution Services, Office of Administration, Division of Budget and Planning, and State Public Defender assume this proposal would not fiscally impact their agencies.

Officials of the Secretary of State's Office (SOS) state that this proposal gives the Gaming Commission the authority to promulgate regulations establishing standards regarding bingo and pull-tab. SOS anticipates that these rules would require approximately 15 pages in the Missouri Register at $22 per page, and 10 pages in the Code of State Regulations at $20 per page. SOS assumes total costs for publishing and distributing these rules would be $605 in FY99. SOS further assumes actual costs could be more or less than the estimate given, and that the impact of this proposal in future years is dependent on the frequency and length of rules filed, amended, or withdrawn. Oversight assumes SOS could increase fees to cover additional costs, per Section 536.033 RSMo, and therefore, will not include any publication costs in the fiscal impact for the proposal.

The Gaming Commission assumes this proposal would have no fiscal impact on their agency. They further assume the removal and additional of certain license fees, as described in this proposal, would affect so few organizations that the net impact would be minimal.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.

DESCRIPTION

This proposal makes various changes relating to the operation and administration of bingo and pull-tab games. Included in these changes are provisions related to abbreviated pull-tab games and licensure, and the removal of the $10 annual fee requirement for bingo organizations which award certain prizes or merchandise valued at less than $5,000 annually or less than $100 per day. This proposal also implements a $25 license fee for organizations which conduct abbreviated pull-tab games, allows certain organizations to be exempt from the restriction on leasing and selling of bingo supplies and participating in the operation of the bingo games, and removes restriction on the selling price of a single bingo card. Current law restricts this amount to no more than 50 cents.

This legislation changes the reporting and record keeping requirements of bingo supply manufacturers, bingo organizations, bingo suppliers, and hall providers, and provides penalties for failure to obtain certain licenses or for using suppliers or bingo hall providers that are not licensed.

This legislation is not federally mandated, would not duplicate any other program, and would not require additional capital improvements or rental space.
