FISCAL ANALYSIS

ASSUMPTION

The Department of Natural Resources (DNR) is unable to determine the fiscal impact of removing the commission's rulemaking authority.

For purposes of this fiscal note, Oversight assumes the proposal would have no direct or predictable effect on the commission and additional costs, if any, to promulgate and defend rules under terms of this proposal compared to current law would be matters for budget decision items.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION

This act, with an emergency clause, corrects a conflict between two printed versions of section 278.080 relating to the soil and water districts commission. The proposal clarifies the ex officio member shall not have the power to vote on any matter before the commission. It also removes the language that states the chair can only vote in instances of a tie. The proposal clarifies a quorum will consist of four farmer members. It also clarifies the number of members required to concur in the determination of matters within the commission's authority. This proposal also removes the commission's rulemaking authority and procedures.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
