FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Conservation, Department of Public Safety, Veterans Commission, Tax Commission, Auditor's Office, Office of Administration - Division of Personnel, Office of Prosecution Services, Highway Patrol, Lieutenant Governor's Office, Missouri House of Representatives, Department of Insurance, Missouri Consolidated Health Care Plan, Department of Social Services, Department of Transportation, Department of Labor and Industrial Relations, Department of Elementary and Secondary Education, Department of Economic Development, State Courts Administrator, Department of Higher Education, Department of Natural Resources, Attorney General's Office, Department of Revenue, Department of Corrections, Office of the Governor, Lottery Commission, State Public Defender, and the Gaming Commission assume this proposal would not fiscally impact their agencies.

In identical legislation introduced during the 1997 regular session, SB 147 (398-01), the following agencies assumed the proposal would not fiscally impact their agencies: State Treasurer's Office, Secretary of State's Office, Missouri Senate, Department of Agriculture, Department of Health, and the Department of Mental Health.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION

The proposal would allow former employers to release certain information pertaining to a former employee to a prospective employer. Unless the lack of good faith could be shown, the employer or designee releasing the information would be immune from civil liability.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
