FISCAL ANALYSIS



ASSUMPTION

Officials of the Department of Social Services and the Department of Corrections assumed in response to an identical proposal that there would be no fiscal impact to their agencies.

Officials of the Office of Administration assumed in response to an identical proposal that the proposal would not fiscally impact their agency. However, they indicated that in times of rapid prison population growth, it could reduce the state and political subdivision's options to contract for space and result in the over building of jail capacity.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION

This proposal would prohibit the operation or management of any correctional facility or jail within Missouri by a private person, corporation, partnership, business, association or other entity unless the facility or jail were already in operation on the effective date of this proposal.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
