FISCAL ANALYSIS

Officials of the Department of Natural Resources, the Department of Elementary and Secondary Education, the Department of Mental Health, the Department of Health, the Department of Social Services stated that the proposal would not have any direct effect on their agencies.

The proposal would by defining funds received due to a settlement as federal funds would remove those funds from the definition of "total state revenues" in section 17 or article X of the state constitution.

Advertisement costs for the proposal would be $3,990 per newspaper column inch for three publications of the text of the proposal, the introduction, title, fiscal note summary, and affidavit. The proposal would be on the ballot for the November 1998 general election.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION

This proposal would specify that funds received by Missouri from a settlement or award related to tobacco settlements approved by Congress or decided in federal courts would be:

1) used for health purposes or purposes specified in the settlement or award,

2) subject to appropriation, and

3) considered "federal funds" as used in section 18 of article X of the Missouri Constitution and not "penalties, forfeitures and fines" as provided in section 7 of article IX.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. The proposal would affect Total State Revenue.
