HB 0777 Restitution by Criminal Offenders
Bill Summary

SCS/HB 777 - A victim of an act of terrorism occurring outside of the United States is eligible for compensation through the Crime Victims' Compensation Fund. This provision is mandated by changes to the Federal Antiterrorism Act. This provision is identical to a provision in SB 430 (TAT).

For certain crimes, a victim may request a hearing to determine the amount of restitution an offender should pay. The court shall order payment of restitution on its own determination or according to a jury determination. The court may require the offender to pay such restitution before such offender is granted probation.

If restitution is ordered for an offender committed to the Department of Corrections, parole shall not be granted unless restitution, as established by the court, is a condition of parole. The Board of Probation and Parole may require that an offender pay restitution before being paroled.

STUDY OF INCARCERATED PARENTS AND THEIR CHILDREN: The Missouri Children's Services Commission shall study laws that affect incarcerated parents and their children, particularly child custody and visitation laws. The Commission shall submit a report its findings to the Governor, Speaker of the House, and President Pro Tem by December 1, 1998. The Commission shall submit a second report on sentencing alternatives impacting such parents and their children by December 1, 2001. These provisions shall terminate on August 28, 2002.

CONTRIBUTIONS TO YOUTH SERVICES TREATMENT FUND: Any member of a Board or Commission may contribute all or part of such member's per diem or reimbursement to the Youth Services Treatment Fund for children who are victims of abuse. The Division of Youth Services shall recommend to the Governor and Department of Social Services how such moneys should be expended.
