HB 0474 Certain Juvenile Court Personnel to Become State Employees
Bill Summary

HS/HCS/HB 474 - Juvenile court personnel employed on or after July 1, 1998 in circuits containing second, third or fourth class counties shall become members of the Missouri State Employees' Retirement System (MOSERS). Any such employee shall receive creditable service in MOSERS for previous service in the juvenile court or previous service in MOSERS. Any employee with at least one year of continuous creditable service shall have any forfeited period of service in MOSERS restored.

Any juvenile court employee who had been in the Local Government Employees' Retirement System (LAGERS) may elect to: 1) transfer credit in LAGERS to MOSERS; or 2) immediately vest in LAGERS. Such election is irrevocable.

CIRCUITS COMPOSED SOLELY OF FIRST CLASS COUNTIES: Any circuit composed only of first class counties shall continue to pay juvenile court personnel out of county funds. The state shall reimburse such circuits at a rate equal to: 1) at least 5% of such circuit's juvenile court personnel budget for calendar year 1996; or 2) the amount received by such county for the period ending December 31, 1996, whichever is greater.

In any circuit not specified above, compensation of juvenile court personnel who were employees in the 1996 budget and certain detention personnel hired in 1997 shall be paid by the state and shall be considered state employees.

Any member of MOSERS who, prior to July 1, 1998, is employed by a circuit comprised solely of a first class county or the city of St. Louis may elect to remain a member of MOSERS if such election is made by October 1, 1998.

REGIONAL JUVENILE DETENTION DISTRICTS: Any two or more counties may form an agreement to establish a regional juvenile jail district. Such agreement shall include terms about how contributions from each county to the district will be calculated and what types of juveniles will be housed in such jail.

This act shall take effect July 1, 1998.
