HB 0389 (Truly Agreed) Updates to "Physically Disabled" Parking Law
Bill Summary

HS/HB 389 - This act revises the law regarding parking and ATV operation by handicapped persons.

DOR REVIEW - The Director of the Department of Revenue shall review all permanent disabled person licensed plates and windshield placards between September 1, 1998 and August 31, 1999. A new physician's statement of physical disability shall be presented for each disabled person during such period. The Director shall determine if the physician who makes a statement of physical disability is duly licensed.

SIGNS, SPACES - Each sign designating a physically disabled parking space shall include a notice that a fine of $50 to $300 may be assessed for parking violation. The color of the signs is no longer required to be white on a blue background. The parking spaces shall meet ADA requirements.

VIOLATIONS - Any person who misuses a license plate or placard to park in a "physically disabled" parking space is guilty of an infraction and subject to a $50 to $300 fine. Notice of any conviction for illegally parking in a disabled parking space shall be forwarded to the Department of Revenue.

ATVs - Handicapped persons may operate ATVs for short distances on secondary roads during daylight hours. NO operator's license shall be required.
