HB 0211 (Truly Agreed) Commercial Feed and Grain
Bill Summary

HB 211 - This act revises the Commercial Feed Law effective January 1, 1998, and the Grain Dealers and Grain Warehouse laws with an emergency clause.

The Commercial Feed Law is revised to allow the Director of Agriculture to regulate the labelling and licensure of any person manufacturing, distributing or appearing as guarantor of commercial feed. The Director is further allowed to license independent consultants providing nutritional formulation. The act also expands the Director's authority to act if products are adulterated and allows for imposition of civil penalties for violations.

The Grain Dealer Law is amended to clarify when title to grain passes and requires licensees to submit to financial statement review by a certified public accountant. Financial requirements for credit sales contracts are amended according to the class of the dealer subject to audit by the Department.

The act further clarifies requirements for scale tickets and creates statutory liens on grain and related assets against a warehouseman in the event of insolvency.
