HB 0069 (Truly Agreed) Arrest Powers of Peace Officers
Bill Summary

CCS/SCS/HS/HCS/HBs 69 & 179 and HCS/HB 669 - This act increases arrest powers for various law enforcement officers.

ARREST POWERS - Officers have authority to respond to emergency situations outside of their political subdivisions if they are authorized to carry a firearm and have successfully completed a law enforcement training program. This does not include an officer employed by a law enforcement agency within a third class county.

A federal officer shall have the same powers as a state certified peace officer when: 1) the federal officer is rendering assistance upon request; or 2) such officer is participating in a bona fide task force or joint investigation. This provision is similar to SB 842 from 1996.

A certified peace officer, including a federal law enforcement officer, may arrest a person without a warrant when such officer sees the person using physical force against another which creates a "substantial risk of death or serious injury". An officer may assert such arrest power anywhere in the state. This portion of the act is similar to a provision contained in SCS/SB 49 et. al.

A commissioned State Park Ranger who is in fresh pursuit of a suspect may pursue such suspect outside of his jurisdiction.

OTHER PROVISIONS: Any case brought against the St. Louis Board of Police Commissioners shall be brought in the Circuit Court of St. Louis.

A person elected as a City Marshal shall file proof, within 6 months after such election, that he has completed necessary training of at least 120 hours pursuant to Chapter 590, RSMo. An extension of this time period may be granted.
