ASSUMPTION

Officials from the Office of State Courts Administrator (CTS) assume the
proposed legislation would not result in an appreciable cost or savings to
the state budget of the judiciary.  CTS assumes this proposal could result in
minimal savings to counties as a result of reduced election expenses.

Officials from the City of St. Louis Circuit Clerk's Office did not respond
to Oversight's request for fiscal information.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

The proposal would require circuit clerks to be appointed rather than elected
as of January 1, 1999.  The circuit clerks initially appointed would be the
ones holding office on December 31, 1998.  The appointments would be made by
the judges of each circuit, en banc.  In those counties where the circuit
clerk also serves as recorder of deeds, the county commission could transfer
this function.  If the commission does not transfer this function, then it
would be transferred to the assessor by operation of law.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
