ASSUMPTION

Officials of the following agencies stated the proposal would have no direct
effect:  Office of the Governor, Lieutenant Governor, Central Missouri State
University, State Tax Commission, Harris-Stowe State College, Missouri House
of Representatives, Missouri Senate, State Treasurer, Department of
Transportation, Office of Prosecution Services, Southwest Missouri State
University, State Public Defender, Missouri Western State College, State
Auditor, Linn State Technical College, Secretary of State, Department of
Elementary and Secondary Education. The Courts Administrator would not expect
enough cases to be filed under this proposal to significantly affect the
courts.

Officials of the following agencies indicated that the proposal would have
uncertain fiscal impact on their agencies: Department of Public
Safety-Director's Office, Department of Revenue, Lottery Commission,
Department of Agriculture, Department of Higher Education, Department of
Insurance, Department of Health, Office of Administration, and Department of
Corrections.

Oversight assumes that the provisions of this proposal would not have any
more impact on state agencies than procedures followed by the Joint Committee
on Administrative Rules until recently.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected due to this
proposal.


DESCRIPTION

This proposal would allow the Joint Committee on Administrative Rules to
recommend to the full General Assembly that it either petition the Cole
County Circuit Court for a declaratory judgement against rules or parts of
rules or that the General Assembly revoke rules or parts of rules by
concurrent resolution within thirty days of the recommendation. The Joint
Committee could make recommendations concerning rules or parts of rules only
for one or more of the following reasons: 1) an absence of statutory
authority for a proposed rule, 2) an emergency relating to public health
safety or welfare, 3) a proposed rule would conflict with state law, or 4) a
substantial change in circumstances since enactment of the law upon which a
rule would be based.

This legislation is not federally mandated, would not duplicate any other
program, would not require additional capital improvements or rental space,
and would not affect total state revenue.
