ASSUMPTION

The Department of Public Safety, Division of Liquor Control (DLC) assumes
this proposal will only affect applicants after the effective date of the
legislation, and all current Retail Liquor by the Drink Resort licenses will
not be impacted.  Thus, DLC assumes this proposal will not have a fiscal
impact on their agency.

FISCAL IMPACT - Small Business

This proposal may affect small businesses in certain counties as it would
prohibit businesses located within 300 feet of any school, church, or other
building used as a place of worship from obtaining a liquor license.


DESCRIPTION

This proposal would forbid granting a license for the sale of intoxicating
liquor to any business located within three hundred feet of any school,
church or other building used as a place of worship in a third classification
county with a 1990 population in excess of 11,700 but less than 12,000
inhabitants.

This legislation is not federally mandated, would not duplicate any other
program, and would not require additional capital improvements or rental
space.
