                              FISCAL ANALYSIS

ASSUMPTION

Officials of the Missouri House of Representatives, the Missouri Senate, and
the Office of Administration all noted that the proposal could cause
increased costs to the chambers of the General Assembly and that they would
not need additional resources to carry out its provisions.

For purposes of this fiscal note, it is assumed that: 1) all legislative
seats will be filled for all days of session, 2) all members will be present
each session day, 3) sessions will average 75 days per year (actual number of
days will vary slightly from year to year), 4) there will be no special
sessions of the legislature, and 5) the per diem allowed federal employees in
Jefferson City will not change during the period covered by this fiscal note.
Since the proposal specifies that legislative per diem will be not more than
the per diem allowed federal employees, costs for the legislature are ranged
from zero to the maximum cost.

197 members x 75 days per session x $51 (difference between current $35 per
diem and $86 proposed per diem) = $753,525 estimated additional cost.

State Courts Administrator officials estimate 508 judges (active and retired)
will attend the Judicial Conference of the State of Missouri. The Conference
lasts three days and will be held in St. Louis this year. The per diem
allowed for federal employees in St. Louis is $120 per day.

508 members x 3 days x $95 (difference between current $35 per diem and $120
proposed per diem) = $144,780 estimated additional cost. It should be noted
that the Courts Administrator has requested an appropriation allowance for an
$86 per day per diem in the budget for the courts. If this request is
granted, additional costs due to this proposal would be $67,056. Since the
$35 per diem is written into law, this fiscal note will reflect $144,780 for
FY 1998. Since it is not decided where future conferences will be held,
Oversight assumes costs for FY's 1999 and 2000 will be based on an $86 per
diem. Since the law specifies that per diem will be not more than the per
diem allowed federal employees, costs are ranged from zero to the maximum
cost.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

This proposal would change the per diem for members of the General Assembly
from thirty-five dollars to no more than the per diem allowed for federal
employees in Jefferson City.

The proposal would change the per diem for participants in the Judicial
Conference of the State of Missouri from no more than thirty-five dollars to
no more than the per diem allowed for federal employees in the city in which
the Conference was being held.

This proposal contains an emergency clause.

This legislation is not federally mandated, would not duplicate any other
program, would not  require additional capital improvements or rental space,
and would not affect total state revenue.
