FISCAL IMPACT - Small Business

Small businesses could be impacted by the proposal, as it could change the
administrative procedures in lawsuits involving certain private construction
projects.


DESCRIPTION

The proposal would amend Chapter 431, RSMo, relating to contracts.  Current
law requires that payments for private construction be made pursuant to a
contract and that a person who is not paid may bring an action in circuit
court.  The proposal would define "person" to include an owner, contractor,
subcontractor, material supplier, construction manager, architect,
professional engineer or land surveyor.  This proposal would not cover
construction work on owner-occupied residential property of four units or
less.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
