ASSUMPTION

Director of Administration for the City of Fulton submitted a list of
changes, however, no fiscal impact statement was made.

Missouri Municipal League assumes no local fiscal impact.

Oversight assumes that excluding the city of Fulton from current law, which
allows for peripheral zoning up to two miles outside their city limits, would
have no state or local fiscal impact.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

Under current law, any city, town, or village north of the Missouri River
with a population of four thousand or more may adopt and enforce planning and
zoning regulations in unincorporated areas under the following conditions:
(1) the unincorporated area does not extend outward more than two miles from
the city limits; (2) there is a correctional facility within two miles of the
city; (3) the county in which both the municipality and the correctional
facility are located do not have zoning laws; and (4) the city has a zoning
commission and a board of adjustment.  This bill modifies the definition to
exclude Fulton from this planning and zoning law.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
