                              FISCAL ANALYSIS

ASSUMPTION

Staff from Department of Public Safety (DPS), Division of Highway Safety
(DHS) stated that they would be responsible for producing educational
materials designed to inform the public on the purpose of reporting and how
to report potentially impaired drivers.  This information is to be provided
to all Department of Revenue licensing offices, publications and community
organizations in order to inform the public and health care professional.
DHS stated that costs were based upon a bill last session which encompassed
an educational component.

Officials from the Missouri State Highway Patrol (MHP) indicated there were
approximately 650 drivers cited in 1996 for retesting.  MHP estimates the
legislation would quadruple the number to 2600 citations, and that each cited
driver would be required to take the full examination.  The current statewide
failure rate is about 23% and MHP believes those cited as being unsafe
drivers would have a 50% failure rate the first test and request a second
test.  Average examination time is 45 minutes driver examination and 15
minutes for a mental acuity test.  MHP indicated they would need three (3
FTE) Driver Examiner I's who would administer and score tests for cited
drivers.

Officials from the Department of Revenue (DOR) Drivers License Bureau (DLB)
stated that as a result of the public awareness campaign conducted by the
Division of Highway Safety the DLB believes the citation requests would
increase and therefore DOR would request one (1) FTE to handle the increased
workload.

In addition, this proposal requires that the physicians serving on the
Medical/Vision Advisory Board have their actual and necessary expenses
reimbursed.  Therefor, DOR estimates expenses in the amount of $6,000 per
year.

This fiscal note has been adjusted from the agency requests to reflect the
results of the Oversight Subcommittee hearing on February 5, 1996 on a
similar piece of legislation.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

The proposed legislation would allow specified persons to report to DOR a
driver they believe cannot safely operate a motor vehicle.  The proposal
would establish a Medical/Vision Advisory Board which would be reimbursed for
their actual and necessary expenses.  Civil liability would be provided for
persons making reports in good faith to DOR.  DPS, Division of Highway
Safety, would be responsible for producing educational materials designed to
inform the public on the purpose of reporting and how to report potentially
impaired drivers.  The proposal has an effective date of January 1, 1998.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
