ASSUMPTION

Officials from the Department of Transportation, the Department of Mental
Health, the Missouri State Highway Patrol, the Department of Social Services,
the Department of Health, the Missouri Consolidated Health Care Plan, the
Department of Conservation, the Department of Economic Development, the
Department of Insurance, the Department of Corrections, and the Office of
Administration assume this proposal would not have a significant fiscal
impact on their agencies.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

This legislation states that an entity contracting with a health professional
cannot discipline or refuse to renew a contract because a health professional
reported a violation of law or mismanagement to a governmental body.  In an
action under this act, a prevailing plaintiff may be awarded an amount at
least equal to actual damages plus attorney fees, but not more than twice the
amount of actual damages plus attorney fees.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
