Current Bill Summary

SB 78 - This act, identical to SB 595 from 1996, immunizes counties, cities and agencies from liability for causes of action which arise as a result of a probationer's or parolee's negligence in the performance of work under supervision. Under current law, immunity only extends to causes of action based upon negligent supervision. Counties, cities and agencies are not immune from actions based upon intentional torts or gross negligence.

No probationer or parolee shall be deemed to be a public employee under Workers' Compensation Law (Chapter 287, RSMo) or Employment Security Law (Chapter 288, RSMo) unless provided otherwise by law, ordinance or order.
