AN ACT

     To amend chapter 386, RSMo, by adding one new section relating to the metropolitan sewer district.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

     Section A. Chapter 386, RSMo, is amended by adding thereto one new section, to be known as section 386.750, to read as follows:

     386.750. 1. On and after the effective date of amendments to the charter of a metropolitan district established under article VI, sections 30(a) and 30(b) of the Missouri constitution, which amendments provide that the sanitary sewer and stormwater services provided by the metropolitan district shall be subject to regulation by the Missouri public service commission, the sanitary sewer and stormwater services provided by the metropolitan district for such utility services shall be regulated by the public service commission as provided in this section.

     2. The provisions of sections 393.110 to 393.285, RSMo, not inconsistent with the charter of such metropolitan district shall apply to sanitary sewer and stormwater services provided by such metropolitan district, except that, in determining the price to be charged for sanitary sewer and stormwater service provided by such metropolitan district under sections 393.150 and 393.270, RSMo, the commission shall give due regard to return upon the value of the property actually used in providing such service in the manner established by the commission as appropriate to services provided by a political subdivision. Such district shall be considered to be a sewer corporation, as defined in section 386.020, except that this shall not be construed to limit any right or power otherwise given to the metropolitan district under the district's charter, the Missouri constitution or any other provision of law.
