To repeal section 105.010, RSMo 1994, relating to the terms of certain public offices, and to enact in lieu thereof one new section relating to the same subject.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

     Section A. Section 105.010, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 105.010, to read as follows:

     105.010. 1. Except as provided in subsections 2 and 3 of this section, all officers elected or appointed by the authority of the laws of this state shall hold their offices until their successors are elected or appointed, commissioned and qualified.

     2. For offices designated in subsection 3 of this section, the governor shall appoint or reappoint an officer within ninety days after the expiration of the term of office. If the governor fails to make a timely appointment or reappointment, said office shall be deemed vacant, and shall be filled in accordance with applicable law.

     3. The appointment or reappointment of the following officers shall be subject to the provisions of subsection 2 of this section:

     (1) Election commissioners, pursuant to chapter 115, RSMo;

     (2) Administrative hearing commissioners, pursuant to chapter 621, RSMo;

     (3) Labor and industrial relations commission members, pursuant to chapter 286, RSMo;

     (4) Police commissioners, pursuant to chapter 84, RSMo;

     (5) Chairman of the state board of mediation, pursuant to chapter 295, RSMo;

     (6) Members of the board of probation and parole, pursuant to chapter 217, RSMo;

     (7) Public service commissioners, pursuant to chapter 386, RSMo;

     (8) State tax commissioners, pursuant to chapter 138, RSMo;     

     (9) Administrative law judges serving the transportation division, pursuant to chapter 622, RSMo;

     (10) County sports complex authority commissioners, pursuant to chapter 64, RSMo; and

     (11) Kansas City area transportation authority commissioners, pursuant to chapter 238, RSMo.
