ASSUMPTION

Officials of the Chesterfield and LeMay Fire Protection Districts assume no
fiscal impact to their districts.

Oversight assume that this proposal extends the procedure to be followed by
cities when annexing property that is receiving fire protection by fire
protection districts, to all cities with a population of at least 2500.
Before fiscal impact to either cities or fire districts would be realized
cities' governing bodies would be required to act.  Therefore, Oversight
assumes that this proposal is permissive and would have no fiscal impact to
state or local funds.

*Fiscal impact to affected local units of government would not occur unless
annexation by certain cities would take place.  This proposal is permissive.


DESCRIPTION

Currently, cities with a population of at least 2,500 but not more than
40,000 which have city fire department and which annex property included in a
fire protection district, the city must assume fire protection
responsibilities and reimburse the fire protection for the loss to the
district's tax base.

This act removes the 40,000 population cap, thereby causing all such cities
with a population of at least 2,500 to comply with these provisions (section
321.322).

The provisions of this section shall not apply to any agreement in existence
as of August 28, 1996, between any city and a fire protection district.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
