ASSUMPTION

Officials from the Office of State Courts Administrator, the Office of the
Attorney General, and the Department of Economic Development - Division of
Professional Registration assume the proposed legislation would have no
fiscal impact on their agencies.

DESCRIPTION

Currently, Section 523.040, RSMo, provides for the appointment of three
commissioners in certain condemnation proceedings.  The proposed legislation
would require that one commissioner be an attorney licensed by the Missouri
Supreme Court, one commissioner be a real estate broker licensed by the
Missouri Real Estate Commission and that the remaining commissioner be a real
estate appraiser licensed or certified by the Missouri Real Estate
Appraisers' Commission.  These commissioners would have to be residents of
the county in which the real estate under consideration is situated.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
