ASSUMPTION

Officials from the Office of State Courts Administrator assume that, although
there would be a potential for a slight decrease in civil filings as a result
of the proposed legislation, overall  there would be no significant fiscal
impact to the judiciary.

Officials from the Department of Economic Development - Division of
Transportation, the Department of Social Services, the Department of Health,
the Office of the Attorney General, and the Department of Mental Health
assume the proposed legislation would have no fiscal impact on their
agencies.

DESCRIPTION

The proposed legislation would expand the scope of civil immunity for
volunteers.  More organizations would be included in the law, and volunteers
transporting the elderly would be immune from negligent actions if they could
fulfill three conditions:  (1) the minimum financial responsibility
requirements of Section 303.025, RSMo, have been met; (2) the volunteer acted
in good faith and within the scope of his services; and (3) the damage or
injury was not caused by the intentional or malicious conduct or the
negligence of such volunteer.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
