                              FISCAL ANALYSIS

ASSUMPTION

Oversight assumes this proposal would allow certain owners of property,
located in second class counties, to recover actual damages caused by
property that has been declared a nuisance.

Therefore, Oversight assumes that there would be no state or local fiscal
impact.

DESCRIPTION

Property in any platted subdivision located in an unincorporated area of
second class county may be declared a nuisance if the property adversely
affects the property values of the neighborhood.  Property owners within a
reasonable distance may bring a nuisance action in small claims court for the
amount of damage to the petitioner's property value.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
