                              FISCAL ANALYSIS

ASSUMPTION

The following agencies do not expect to be fiscally impacted by this
proposal:  State Treasurer's Office (STO), Department of Health (DOH),
Governor's Office (GOV), Department of Economic Development (DED), Department
of Revenue (DOR), Attorney General (AGO), Missouri State Senate (SEN),
Missouri Lottery Commission (LOT), State Auditor's Office (SAU), Department
of Social Services (DOS), Department of Insurance (INS), Missouri House of
Representatives (MHR), Missouri Tax Commission (TAX), Coordinating Board for
Higher Education (CBH), and Highway & Transportation Employee's & Highway
Patrol Retirement System (HRS).

The Office of State Courts Administrator (CTS) does not expect this proposal
to have an appreciable impact on the budget of the judiciary.  Oversight
assumes that the fiscal impact would be zero.

The Department of Labor & Industrial Relations (DOL), Labor & Industrial
Relations Commission, Department of Elementary & Secondary Education (DES)
Department of Conservation (MDC), Department of Natural Resources (DNR),
Department of Mental Health (DMH), and Department of Agriculture (DOA) do not
expect this proposal to result in a direct fiscal impact, but the absence of
employees could cause a backlog of work and require rescheduling of other
employees to cover for absent employees.

The Department of Corrections (DOC) and the Secretary of State (SOS)
indicated an unknown fiscal impact.  These agencies indicated an unknown
fiscal impact because it could not be determined the number of persons that
could be involved in the civil air patrol or the amount of time which would
be required, especially in emergency situations.  In order to maintain the
status quo, it could become necessary to hire temporary personnel.  Oversight
assumes that existing personnel could be utilized to handle any backlog of
work, resulting in a zero fiscal impact.

The Department of Highway & Transportation (DHT) indicated that it was
difficult to provide an accurate estimate of costs related to this proposal
since the number of employees who are currently involved or would become
involved in the civil air patrol was unknown.  The average monthly salary for
a DHT employee is estimated at $2,333 per month.  If an employee was granted
leave for 15 days during a 21 working day month, the cost would be $1,666 per
year per employee.

The Office of Administration (OA), Division of Personnel estimated the
average cost for fifteen days of leave at $1,387, with fringe benefits of
$429 for a total payroll cost of $1,816 per employee.  Currently, there are
about 450 employees in the patrol with approximately twelve working for the
state.  If these twelve employees were to take the 15 days per year the cost
would be $21,792 in FY97; $22,337 in FY98; and $22,896 in FY99.

Oversight assumes that the costs estimated by DHT and OA, Division of
Personnel would not be new costs, but costs of salaries already being paid to
these employees.  As noted with several other agencies, there could be a
backlog in work which would requiring re-scheduling employees to provide
coverage.

DESCRIPTION

The proposal would allow any state employee who is or may become a civil air
patrol or has qualified for a civil air patrol emergency service specialty
rating to be granted a leave of absence without loss of time, pay, regular
leave, impairment of efficiency rating or any other rights or benefits.
Leave would not be granted for more than fifteen working days in any state
fiscal year unless for a state or national emergency.  Leave would be
requested by the Missouri wing commander or designee.

The employee would receive regular pay during the leave, but prior to the
salary being paid, the employee would be required to file with the appointing
authority or supervising agency evidence of participation from the wing
commander or designee.  No member of the civil air patrol could be
discharged, discriminated against or dissuaded from joining or continuing
service in the civil air patrol.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
