                              FISCAL ANALYSIS

ASSUMPTION

The Department of Social Services (DOS), Division of Youth Services (DYS)
does not expect to be fiscally impacted.

The Office of State Courts (CTS) would not be directly impacted by this
proposal.  However, the courts at the local level could anticipate additional
income.  According to CTS, in FY95 there were 1,526 convictions in the 30th
Judicial Circuit.  If an additional $10 fee were assessed as court costs the
maximum amount of income generated could be $15,260.  Some of these cases
could involve indigents and a fee would not be assessed, but for purposes of
this fiscal note, the maximum amount possible has been shown as income.

In addition to the state convictions, income could be generated from the
municipal courts.  The amount would be unknown since there is no central
reporting of these cases.  The CTS indicated that municipal collections could
exceed the state collections.

It is assumed that costs could be incurred if the circuit judge recommends
the funds be used to fund a juvenile detention facility.  If this were to
happen, then the net fiscal impact would be zero.  Since expending the funds
is discretionary costs have not been shown.

DESCRIPTION

The proposal would allow an additional $10 fee to be assessed as costs in
each court proceeding filed in any court within the Thirtieth Judicial
Circuit for violations of the general criminal laws of the state, with
exceptions as noted in the proposal.  The fees would be collected by the
appropriate official of the court and transmitted monthly to the treasurer of
the county where the violation occurred.

All fees could be used to fund a juvenile detention facility if such a
facility were recommended by the circuit judge of the circuit.  The county
commissions within the circuit could contract to pay the costs of such a
facility.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
