ASSUMPTION

Officials from the Department of Health, the Department of Mental Health, the
Department of Social Services, the Office of Attorney General, the Office of
State Courts Administrator, the Office of Prosecution Services, the Office of
State Public Defender, and the Department of Economic Development - Division
of Professional Registration assume this proposal would not fiscally impact
their agencies.

DESCRIPTION

An individual would not be subject to a criminal or civil penalty for
possessing marijuana if a practitioner authorized to prescribe schedule II
controlled substances certifies in writing that the person is under the
professional care of the practitioner for duly diagnosed condition and that
the  practitioner certifies in writing that the person needs marijuana as
part of a therapeutic regimen.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
