                              FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Public Safety (DPS) assume no fiscal impact
to the Highway Patrol.

Officials from Marion County assumes no fiscal impact.

Officials from Stone County assume that if the county were to post limits
that there would be costs.

Officials from the Department of Highways and Transportation (DHT) stated
that there would be no fiscal impact to their department.

Officials from the Office of the State Courts (CTS) Administrator stated that
revenue from traffic fines currently are placed in the County School Fund.

Oversight assumes this proposal is permissive.  Implementation of this
proposal would be determined by the governing bodies of the affected county
and costs would be minimal, consisting of the erection of new road signs.
Oversight has stated an unknown cost to local governments, expected to be
less than $100,000 annually.  Oversight assumes any revenue from traffic
fines would be insignificant and is indeterminable in amount.

DESCRIPTION

This act permits the county commission in third class counties to set speed
limits, on county roads outside of any city, town, or village.  The speed
limit set by the commission may not be lower than 25 miles per hour.
Currently, this section (49.267) only grants this authority to county
commission in second class counties.

Counties opting to set limits would be responsible for furnishing the signs
in a form approved by the Department of Highways and Transportation.

All revenue from traffic fines would be deposited in the County School Fund.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
