                              FISCAL ANALYSIS

ASSUMPTION

Officials from the Office of State Courts Administrator (CTS) would expect
one or two cases to test the parameters of the law.  However, they would not
anticipate an appreciable increase in the workload of the courts.

Officials from the Department of Public Safety (DPS), Division of Highway
Safety (DHS) stated they currently provide public information and educational
materials associated with traffic, safety issues, therefore no additional
staff or program funds would be needed to comply with the provisions of this
proposal.

Officials from the Department of Revenue (DOR), Drivers License Bureau
stated they believe the citation requests would increase and therefore DOR
would require one (1) FTE to handle the increased workload.

The proposal states that the newly established five member advisory board
would be reimbursed for actual and necessary expenses incurred in the
performance of their duties.  Oversight assumes there would be the maximum
(4) meetings a year, with each meeting consisting of two nights lodging.
According to information provided by another state agency, Oversight will use
$125 a day reimbursement rate.  5 members x $125 a day = $625 x 2 nights =
$1,250 x 4 meetings = $5,000 expenses a year.

Officials from the Missouri State Highway Patrol (MHP) indicated there were
approximately 528 drivers cited in 1995 for retesting.  MHP estimates the
legislation would quadruple the number to 2112 citations, and that each cited
driver would be required to take the full examination.  MHP indicated they
would need two (2 FTE) Driver Examiner I's who would administer and score
tests for cited drivers.

DESCRIPTION

The proposed legislation would allow specified persons to report to DOR a
driver they believe cannot safely operate a motor vehicle.  The proposal
provides that the cost of each physical or mental examination shall be paid
by the person tested.  The proposal establishes a Medical/Vision Advisory
Board which would be reimbursed for their actual and necessary expenses. The
proposal also provides civil liability immunity for persons making reports in
good faith to DOR.  The proposal has an effective date of January 1, 1997.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
