                              FISCAL ANALYSIS

ASSUMPTION

Officials of the Department of Public Safety - Missouri State Highway Patrol
assumed that this proposal would have no fiscal impact to their agency.

Officials of the Department of Public Safety - Missouri State Water Patrol,
Offices of the Attorney General, the State Courts Administrator, the State
Public Defender, and the Office of Administration assumed in response to a
similar proposal that their agencies would not be fiscally impacted.

Officials of the Office of Prosecution Services assume this proposal would
not fiscally impact their agency.  They indicated that this proposal creates
a new crime, which could cause increased workload for counties; however,
actual fiscal impact on the counties is not known.

Oversight assumes county prosecutors would request additional resources as
needed through regular local government budgeting procedures, and is
therefore showing no local fiscal impact.

Officials of the Department of Corrections (DOC) stated that there was no
data to determine the number of people that would be prosecuted under the
provisions of this proposal.  DOC officials assume that few convictions would
result in incarceration.  Punishment for those types of crimes would most
likely result in fines, jail time, community-based sanctions or probation.
DOC officials noted that probation could result in some additional costs for
supervision, but assumed potential costs would be minimal.

DESCRIPTION

This legislation would make leaving the scene where serious physical injury
or death had occurred due to an accident or the negligence of that person
without giving their name, address, and driver's license number, if
applicable, to a law enforcement officer or emergency medical personnel.

A person would not violate this law if he left to get medical help, or to
notify the police, or the victim had requested that no assistance be given.
A person leaving the scene would be guilty of a class A misdemeanor; or a
class D felony if he had previously pled guilty to or been found guilty of a
violation of this section.

This proposal would give all peace officers and reserve peace officers
certified under the provisions of chapter 590, RSMo, the authority to
investigate serious physical injury or death which had occurred due to an
accident or negligence of a person and the authority to arrest a person who
had violated this proposal, except that conservation agents could enforce the
provisions as to hunting related accidents.  This proposal also defines
"hunting accident" as any accident in which a person is injured as a result
of hunting activity that involved the discharge of a hunting weapon which did
not occur within a residential area.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
