AN ACT

To authorize the conveyance of certain lands by the department of highways and transportation and the department of natural resources in Shannon County and in Jefferson County, with an emergency clause for one section.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section 1. The department of highways and transportation is authorized to convey certain lands in Shannon County for valuable consideration based upon the appraisal of the property and as agreed to by the parties.

Section 2. The tract of land to be conveyed under section 1 of this act is more particularly described as follows:

All that part of the Southwest Quarter of the Southeast Quarter of Section 29, Township 30 North, Range 4 West, Shannon County, Missouri, which lies within a width of 100 feet on each side of the following described survey center line of highway now known as Route 19; EXCEPTING therefrom a parcel 100 feet in width lying within 50 feet on each side of the said following described survey center line of Route 19, which is being retained as permanent Right of Way, conveying a total of 2.36 acres of land.

Also, all that part of the East Half of Section 32 and all that part of the East Half of the Southwest Quarter of Section 32, all in Township 30 North, Range 4 West, Shannon County, Missouri, which lies within a width of 200 feet on each side of the following described survey center line of highway now known as Route 19; EXCEPTING therefrom a parcel 100 feet in width lying within 50 feet on each side of the said following described survey center line of Route 19, which is being retained as permanent Right of Way, conveying a total of 39.06 acres of land.

The survey center line of highway Route 19, Shannon County, is located and described as follows:

Beginning at a point on the west boundary of said Southwest Quarter of the Southeast Quarter of Section 29, distant 595 feet, more or less, north of the southwest corner thereof at or near Station 761+75; thence from a tangent bearing South 49ø 05' East deflect to the left on a 9ø 30' curve 175.1 feet; thence on tangent to said curve South 65ø 43' East 397.8 feet; thence deflect to the right on a 10ø curve 462.5 feet; thence on tangent to said curve South 19ø 28' East 1003.4 feet; thence deflect to the right on a 4ø curve (delta angle 14ø 19') 357.9 feet; thence on tangent to said curve South 5ø 09' East 996.9 feet; thence deflect to the right on a 14ø curve (delta angle 50ø 51') 363.2 feet; thence on tangent to said curve South 45ø 42' West 868 feet; thence deflect to the left on a 3ø 30' curve (delta angle 54ø 31') 1557.6 feet; thence on tangent to said curve South 8ø 49' East 518.6 feet to a point on the south boundary of the Southwest Quarter of the Southeast Quarter of said Section 32, distant 197 feet east of the southwest corner thereof, and there terminating at or near Station 828+76.

Section 3. The attorney general shall approve the form of the conveyance described in sections 1 and 2 of this act.

Section 4. 1. The director of the department of natural resources shall grant and convey a permanent easement to the consolidated public water supply district #C-1 of Jefferson County, Missouri, to construct, operate, maintain, add to and use a water line upon certain lands in Mastodon state park. The easement shall consist of a permanent easement through land known as lots 61 & 62, major general hancock reserve, lots 51, 52, 54, 55 & 60, William H. Bell's sulphur spring tract, lot 23 of wood lynn terrace addition, and a part of U.S. Survey 2021, township 42 north, ranges 5 and 6 east, jefferson county, Missouri.

2. The permanent easement is more particularly described as follows:

Beginning at a point North 81 degrees 48 minutes 40 seconds West a distance of 3.93 feet from a right- of-way marker located 324.51 feet radially distance Westerly of Station 298 + 64.68 of Interstate Highway 55; thence North 81 degrees 48 minutes 40 seconds west a distance of 3.93 feet; thence North 31 degrees 59 minutes 30 seconds West a distance of 12.46 feet; thence North 58 degrees 00 minutes 30 seconds East a distance of 40.00 feet; thence South 31 degrees 59 minutes 30 seconds East a distance of 15.00 feet; thence South 58 degrees 00 minutes 30 seconds West a distance of 37.00 feet; to the point of beginning, containing 0.014 acres, more or less.

3. The authority to convey the easement described in this section is granted subject to the following provisions:

(1) The area disturbed by the construction of the water line shall be adequately repaired and reseeded by the water supply district; and

(2) The attorney general shall approve the instrument of conveyance.

Section A. Because immediate action is necessary in order to properly install needed water supply facilities, section 4 of this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section 4 of this act shall be in full force and effect upon its passage and approval.
