AN ACT

To repeal section 226.030, RSMo 1994, relating to the highways and transportation commission, and to enact in lieu thereof one new section relating to the same subject.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Section 226.030, RSMo 1994, is repealed and one new section enacted in lieu thereof to be known as section 226.030, to read as follows:

226.030. The state highways and transportation commission shall consist of [six] eight members, who shall be appointed by the governor, by and with the advice and consent of the senate, not more than three thereof to be members of the same political party. Each commissioner shall be a taxpayer and resident of state for at least five years prior to his appointment, and the commissioners shall be appointed from the following geographic areas:

(1) One from northwest Missouri;

(2) One from northeast Missouri;

(3) One from southwest Missouri;

(4) One from southeast Missouri;

(5) One from central Missouri;

(6) One from the area containing a city with a population of over four hundred thousand which is located in more than one county and containing each county in which such city is located; and

(7) Two from the Missouri areas represented by the metropolitan planning organization designated under Title 23 of the U.S. Code, section 134 for the largest metropolitan area in the state.

Any commissioner may be removed by the governor if fully satisfied of his inefficiency, neglect of duty, or misconduct in office. All commissioners appointed prior to October 13, 1965, shall serve the term for which they were appointed. Commissioners appointed pursuant to this section shall be appointed for terms of six years, except that the successors of the terms expiring on October 13, 2001 shall be appointed to terms expiring on December 1, 2007, and the two new commissioners appointed on or after August 28, 1996, shall serve terms expiring December 1, 1999. Upon the expiration of each of the foregoing terms of these commissioners a successor shall be appointed for a term of six years or until his successor is appointed and qualified which term of six years shall thereafter be the length of term of each member of the commission unless removed as above provided. The members of the commission shall receive as compensation for their services twenty-five dollars per day for the time spent in the performance of their official duties, and also their necessary traveling and other expenses incurred while actually engaged in the discharge of their official duties.
