AN ACT

To amend chapter 195, RSMo, relating to controlled substances, by adding one new section relating to the same subject.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Chapter 195, RSMo, is amended by adding thereto one new section, to be known as section 195.183, to read as follows:

195.183. No criminal or civil penalty shall apply to any person for the act of possessing marijuana provided that requirements of the following three subdivisions of this section are met simultaneously:

(1) A practitioner authorized to prescribe Schedule II controlled substances for human use certifies in writing that the person is under the professional care of the practitioner for a duly diagnosed condition;

(2) The aforesaid practitioner certifies in writing that the person needs marijuana as part of a therapeutic regimen directed against the duly diagnosed condition; and

(3) The amount of marijuana possessed is less than seventy grams.
