AN ACT

To amend chapter 483, RSMo, relating to circuit clerks, by adding one new section relating to the same subject.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Chapter 483, RSMo, is amended by adding thereto one new section to be known as section 483.163, to read as follows:

483.163. 1. Each circuit clerk shall cooperate with the prosecuting attorney and division of child support enforcement in the investigation and documentation of possible criminal non-support under section 568.040, RSMo, which involves any case or cases for which the clerk is trustee.

2. Other provisions of law to the contrary notwithstanding, for the performance of the duties prescribed in subsection 1 of this section, each circuit clerk, in addition to any other compensation provided by law, shall receive the following compensation per year beginning January 1, 1997, payable in equal installments in the same manner and at the same time as his other compensation is paid:

(1) For a circuit clerk in a county with fewer than one thousand trusteeships for the receipt of child support payments as of June 30, 1995, one thousand two hundred fifty dollars;

(2) For a circuit clerk in a county with at least one thousand but fewer than two thousand five hundred trusteeships for the receipt of child support payments, as of June 30, 1995, two thousand five hundred dollars;

(3) For a circuit clerk in a county with at least two thousand five hundred trusteeships for the receipt of child support payments as of June 30, 1995, three thousand seven hundred and fifty dollars.

3. In addition to the compensation provided for in subsection 2 and any other provision of law, each circuit clerk shall receive the following compensation per year beginning January 1, 1997 for the performance of the duties prescribed in subsection 1 of this section payable in equal installments in the same manner and at the same time as his other compensation is paid:

(1) For a circuit clerk in a county where fewer than one hundred petitions or charges were filed pursuant to sections 454.110 or 568.040, RSMo, during fiscal year 1994, one thousand two hundred and fifty dollars;

(2) For a circuit clerk in a county where at least one hundred but fewer than five hundred petitions or charges were filed pursuant to sections 454.100 to 568.040, RSMo, during fiscal year 1994, two thousand five hundred dollars;

(3) For a circuit clerk in a county where at least five hundred petitions or charges were filed pursuant to sections 454.100 or 568.040, RSMo, during fiscal year 1994, three thousand seven hundred and fifty dollars.

4. For every fiscal year beginning July 1, 1997, the amount of increased compensation established in subsections 2 and 3 of this section shall be adjusted by any salary adjustment authorized pursuant to section 476.405, RSMo.
