SCS/SB 711 - This act makes it unlawful to sell motor fuel below cost if the intent or effect of the sale is to injure competition. Currently, it is only unlawful to sell motor fuel below cost if the intent of the sale is to injure competition.

The identity of any person who requests that the prosecuting attorney investigate a suspected violation of this act shall be a public record.

This legislation reenacts Section 416.640, RSMo, repealed in 1995, allowing a prima facie case to be shown by proof of sale below cost and injury to competition. The defendant shall have the burden of coming forward with evidence that sales were made at or above cost.

This act is similar to SB 536 (1996).
