Current Bill Summary

SB 160 - This act requires a person conducting a going out of business sale to submit an inventory of all sale items to the Attorney General (AG). This list may be by category with total dollar value in the category. No items may be added to the sale once the inventory is submitted. The time period for an extension beyond 60 days shall be determined by the AG. A local prosecutor may prosecute a violation if the AG fails to take action within 120 days of the violation. A violation of this act shall be considered an unlawful merchandising practice and is a Class D felony if committed with intent to defraud.

The act contains penalty provisions.
