HB 102 -- Unlawful Detainer

This bill repeals an exemption in the unlawful detainer law. Unlawful detainer occurs when a tenant refuses to relinquish possession of property after the expiration of a lease. Under current law, a person who has had uninterrupted occupation or possession of land, a building, or a house for 3 years prior to the filing of an unlawful detainer action or who has had peaceable possession of land, a building, or a house for 3 years following the expiration of the lease is not subject to the unlawful detainer law. The bill repeals this exemption which will allow property owners to bring an unlawful detainer action to regain possession of their property in every circumstance.
