SB 266 - Under this act, it is unlawful: to discharge contaminants that reduce the quality of waters below the standards established by the Clean Water Commission of the State of Missouri ("Commission"); to discharge contaminants exceeding the amounts permitted by the State regulations; to discharge any toxic waste into the waters; to operate or use any water contaminant without a permit from the Commission, unless the contaminant is operated or used by a publicly owned facility; to construct or modify human sewage facilities unless a certain exclusion applies.

Additionally, this act regulates the discharge of earthen materials into the waters.

Furthermore, the act delegates authority to the Department of Natural Resources ("Department") to authorize and regulate the point source system program pertaining to the storage and discharge of process wastewater, including the issuance and regulation of permits, fee regulation, and delegation of authority to local government units to supervise local wastewater discharge programs. A local governmental unit may apply to the Department for a permit to operate a local wastewater program, including conducting engineering work, supervision of site construction, and compliance with relevant permit requirements.

Under this act, Commission decisions pursuant to a hearing are subject to judicial review.

Under this act, the Director for the Department is to publish a public notice and to hold a public information meeting pertaining to permit issuance. Furthermore, the Director for the Department is to hold a thirty-day public comment period.
